General Terms and Conditions of the Stiftung Staatstheater Nürnberg
Foreword
The personal references used in these General Terms and Conditions apply to both female and male persons. The Stiftung Staatstheater Nürnberg is hereinafter referred to as the "Foundation".
The General Terms and Conditions (hereinafter referred to as GTC) govern the legal relationship between the Foundation and its visitors for all events taking place at the Staatstheater Nürnberg. In the case of theatre rentals and guest performances, the ticket sales are governed by the terms and conditions of the rent payer and/or special regulations. With the purchase of an entry ticket, the conclusion of a subscription contract or the purchase of an item, these terms and conditions are deemed to be agreed. The respective subscription conditions also apply to subscribers.
The Foundation does not recognise deviating conditions unless it explicitly consents to their validity.
2.1 Only the official publications issued by the Foundation shall specify the binding starting hours of the performances.
The Foundation reserves the right to make changes at short notice. The Foundation accepts no responsibility for information in other publications. Claims for damages of any kind are hereby explicitly excluded.
2.2 The venues will typically open 60 minutes before the start of the respective performance.
2.3 The entitlement to the booked seat expires at the start of the event. You may be allocated substitute seats in other seating groups. You are not guaranteed to be admitted after the start of the performance. For safety reasons and out of consideration for the artists and other visitors, visitors may only be admitted to the auditorium following a reasonable interval after the start of a performance; the admission staff must be strictly obeyed. This does not entitle the visitor to any claims against the Foundation. If a visitor is not granted admission due to his/her later than scheduled arrival, he/she is not entitled to a refund of the ticket price.
2.4 Admission is granted to anyone who presents a valid entry ticket for the performance printed on the ticket on the day of his/her visit to the theatre. No additional services are included in the ticket price, unless stated on the front of the entry ticket. For the fixed subscriptions, the subscription card is valid as an entry ticket.
Theatre cheques must be redeemed for entry tickets before attending the performance.
2.5 In the case of discounted tickets, the respective discount entitlement must also be shown to the facility managerial staff at the front of the building. Discounted tickets are only valid when presented together with the identification document confirming the entitlement to the discount. If the ID cannot be shown, the difference to the full ticket price must be paid at the box office concerned.
2.6 When using a ticket issued by the "Print@Home" method, a valid identification document containing personal details that match the details on the respective ticket must be presented at the entrance.
3.1 Different price categories and seating groups apply to the Foundation's events.
3.2 The current entry fees, discount entitlements and special provisions will be published on the Foundation's homepage (only within the webshop).
The events of the Staatstheater Nürnberg are not suitable for children under the age of 3. It is therefore not permitted to bring children under the age of 3 - even when accompanied by adults. The only exceptions to this are productions specifically designated for children under 3 years of age.
3.3 The ticket price includes the charge for cloakroom storage and any other fees. In accordance with the ticket imprint, the ticket price includes the entitlement to use the entry ticket also for all VGN modes of transport 4 hours prior to the event until the end of operating hours (entire interconnected area, DB 2nd class, trains without surcharges) for one outward journey and one return journey. In all other respects, the VGN community tariff applies. With regard to the use of the entry ticket as a travelling ticket, a separate contractual relationship is in force between the customer and the transport company, to which the provisions of the transport companies belonging to the VGN apply. Please note that it is of no relevance whether the visitor makes use of the corresponding service or not.
3.4 Programme booklets, textbooks and other services are not included in the ticket price.
4.1 Written sales
4.1.1 Advance written orders (orders placed by post or email prior to the start of advance booking) will be accepted at any time.
4.1.2 They will be processed on a first-come, first-served basis approximately one week prior to the respective start date of advance booking. You do not have a right to have your request processed in the order in which it is received.
4.1.3 If the number of tickets ordered in writing exceeds the quotas provided for this purpose, the delivery of tickets for the respective performance per order may be limited.
4.1.4 Customers who have placed their orders in advance will receive notification of the reservation of specific seats at the beginning of the respective advance booking. You have no right to requested places. A date for booking is stated in this notification. Until this date, tickets can be requested by telephone, email or in person, i.e. booked or collected. The tickets remain reserved until this date. Once the date for booking has passed, the reserved tickets will go on sale again without further notification and the reservation will be automatically cancelled.
4.1.5 Written orders after the start of the advance booking period will be processed in the order in which they are received. You do not have a right to have your request processed in the order in which it is received.
4.2 Over-the-counter sales and reservations
4.2.1 The opening hours of the theatre box offices shall be announced separately by a notice and in the Foundation's publications. The box office opens one hour before the start of each performance.
4.2.2 In musical theatre, advance booking of over-the-counter sales begins on the first working day of the preceding month, i.e. for the performances from 01 to 30 November up to and including, on 01 September, for example. In spoken theatre, advance booking of over-the-counter sales begin on the first working day of the preceding month, i.e. for the performances from 01 to 30 November up to and including, on 01 October, for example.
4.2.3 Tickets can be reserved for a maximum of 6 working days and up to a maximum of 3 working days before a performance. After that, the reserved tickets automatically go back on sale without further notification, and the reservation is automatically cancelled.
4.3 Sales by telephone
4.3.1 Telephone orders may be placed when over-the-counter sales begin. Theatre box office hours will be announced separately by notice and in Foundation publications.
4.3.2 Telephone orders placed before the start of advance booking will be recorded and processed in accordance with No. 4.1 of these General Terms and Conditions.
4.3.3 Telephone orders after the start of the advance booking will be processed immediately.
4.3.4 Tickets can be reserved for a maximum of 6 working days and up to a maximum of 3 working days before a performance. After that, the reserved tickets automatically go back on sale without further notification, and the reservation is automatically cancelled.
4.4 Online sales
4.4.1 Online orders may be placed when over-the-counter sales begin.
4.4.2 Payment for tickets ordered online can only be made by credit card or SEPA direct debit. Fees may be charged for payment by credit card. Payment by credit card is subject to approval by the card issuer, payment by SEPA direct debit authorisation is subject to approval by the customer's bank. Entry tickets of the Foundation remain the property of the Foundation until full payment of the final invoice amount. Entry tickets are deemed to have been paid for when the full final invoice amount has been credited to the account of the Foundation or Staatstheater Nürnberg Service GmbH. If a payment is redebited, the customer is obliged to reimburse the costs incurred by the redebiting.
4.4.3 In other respects, the statutory provisions shall apply to online sales.
4.4.4 In the case of tickets purchased online using the Print@Home procedure, the name and date of birth of the respective holder of the ticket must be stated when purchasing the ticket.
When used at the entrance checkpoint, the entry ticket printed out by the purchaser must not be damaged, soiled or otherwise impaired in any way that makes it impossible or impedes/obstructs the entrance check. In the event of such damage, soiling or other impairments, there shall be no entitlement to admission or to a refund of the fee paid by the purchaser. This also applies in the event of loss of the "Print@Home" entry ticket.
Any reproduction, copying, modification or imitation of the "Print@Home" entry ticket and any electronic distribution of the PDF file is explicitly prohibited.
4.5 Ticket dispatch and payment options
4.5.1 The customer always has the option of having tickets that have been ordered and already paid for delivered up to 7 working days before the performance.
4.5.2 The tickets are always delivered to the customer at his/her
4.5.3 The tickets can be collected at the box office - at the earliest at the start of the over-the-counter sales for this performance - on the day of the performance after payment has been made in advance, at the express request of the customer or if it is not possible to deliver the tickets in good time.
4.5.4 When collecting tickets that were paid for by credit card, the relevant credit card and proof of identification must be presented.
4.5.5 For the dispatch of tickets, a dispatch and handling fee is generally charged per order.
4.5.6 Entry tickets may only be paid for in euros. Payment can be made in cash, by EC or credit card or by SEPA direct debit authorisation. Fees may be charged for payment by credit card. The ticket office staff is entitled to refuse to accept 1- and 2-cent coins worth more than 10 cents and 5-cent coins worth more than 30 cents. Damaged, inscribed or otherwise altered notes or coins will not be accepted. Change received must be checked immediately. Any claims made at a later point in time are void.
Payment by credit card is subject to approval by the card issuer, payment by SEPA direct debit authorisation is subject to approval by the customer's bank. Entry tickets of the Foundation remain the property of the Foundation until full payment of the final invoice amount. In the case of cashless payment, entry tickets are deemed to have been paid for when the full final invoice amount has been credited to the account of the Foundation or Staatstheater Nürnberg Service GmbH. If a payment is redebited, the customer is obliged to reimburse the costs incurred by the redebiting.
5.1 There is no right of cancellation or return for tickets ordered pursuant to §§ 312c in conjunction with 312g para. 2 no. 9 of the German Civil Code. As a matter of principle, sold entry tickets are neither returnable nor exchangeable. No replacement will be provided for expired tickets.
5.2 Changes to the casting line-up and other changes to the performance schedule do not entitle the holder to return entry tickets.
5.3 If another work is performed instead of the one announced when the entry ticket was purchased, the substitute performance may be attended or the purchased tickets may be returned up to the start of the performance; in the event of a change or cancellation of a performance at short notice, it will be possible to return the tickets within 14 calendar days of the original performance date.
5.4 If a performance is cancelled, the admission fee will only be refunded if less than half of the performance had been presented when the performance was cancelled. The refund claim expires if it is not asserted within 14 days.
5.5 No compensation will be paid in the event of performance cancellations due to strike or force majeure. If the start of the performance is delayed by more than 40 minutes, purchased entry tickets will be taken back until the start of the performance. As a rule, the ticket price will not be refunded at a later date.
5.6 For all aforementioned ticket redemptions, it is mandatory that the tickets are presented at one of the theatre box offices within the deadline. The ticket price will only be refunded in cash and/or to the account that was originally used for payment. Advance booking or postage fees paid will not be refunded. Any claims beyond this are hereby excluded.
5.7 In addition to the claim for reimbursement of the ticket price regulated in the above paragraphs, further expenses or damages incurred by the visitor shall not be reimbursed.
6.1 If an entry ticket is lost, a one-off replacement ticket can be issued at the box office if the visitor can prove or credibly demonstrate which ticket was purchased, giving exact details of the seat. An issuing fee may be charged for this.
6.2 If both the original ticket and a replacement ticket for the same seat are presented by different visitors, the owner of the original ticket has priority over the owner of the replacement ticket. In this case, the replacement ticket does not entitle the holder to a different seat or a refund of the purchase price. The Foundation is not obligated to check whether the owner of the original ticket is the owner of the replacement ticket.
Fees will be charged for the subsequent processing of confirmed ticket purchases.
8.1 Your belongings (especially coats, jackets, umbrellas, canes (except walking aids), walkers, wheelchairs, large bags, rucksacks, similarly bulky items and image recording equipment) may not be taken into the auditorium and must be handed over to the relevant facility managerial staff at the front of the building. If wheelchairs or walkers are used, the facility managerial staff at the front of the building will provide substitute walking aids, unless a special wheelchair seat has been booked for the wheelchair user. Please note that animals and hazardous objects are not permitted on the premises. The customer will receive a cloakroom ticket that serves as proof of admission.
8.2 When a cloakroom ticket is handed over, the Foundation is liable for loss or damage only if the cloakroom staff have violated their storage obligations intentionally or through gross negligence. Liability is limited to the current value of all items handed in on a cloakroom ticket and amounts to a maximum of € 500. Excluded from liability are identity cards and documents of all kinds, credit cards, cash, keys and valuables such as jewellery, electronic devices, etc., especially if these items are in coat pockets or cases. These items are to be stored at the visitor's own risk.
8.3 The items will be handed out without any further authorisation check upon presentation of the cloakroom ticket.
8.4 Loss of or damage to cloakroom items as well as the loss of a cloakroom ticket must be reported immediately to the cloakroom staff.
Cloakroom items may only be handed out without a cloakroom ticket if it is credibly shown that the visitor is the authorised recipient. In the event of loss of the cloakroom ticket, monetary compensation equivalent to the cost of replacement of the ticket may be demanded.
9.1 Objects of any kind found in the venues of the Foundation are to be handed over to the facility managerial staff at the front of the building. The loss of items must be reported to the facility managerial staff at the front of the building.
9.2 The further handling of lost property shall be governed by the statutory provisions (§§ 978 et seq of the German Civil Code).
10.1 Customers may only enter via the ticket counter lobby to purchase entry tickets or to attend the performance. Wheelchair users can access the Opernhaus via the lift on the left-hand side of the building.
Only guests of the events may use the toilets from the time of opening of the lobby.
10.2 The Foundation exercises domiciliary rights in all its venues. The instructions of the facility managerial staff at the front of the building and the evening performance management must be adhered to. The Foundation is entitled to expel and ban visitors or to take other appropriate measures within the framework of this domiciliary right. Visitors may especially be expelled from performances if they disturb the performance, harass other visitors or have violated the conditions of use in any other significant way or on repeated basis. Admission can be refused if there is a justified suspicion that the visitor will disrupt the performance or disturb other visitors. In such cases, the ticket price will not be refunded.
10.3 The visitor may only take the seat indicated on his/her entry ticket. If he/she takes a seat for which he/she does not have a valid ticket, the Foundation may charge the differential amount or expel the visitor from the performance. In such cases, the ticket price will not be refunded.
Severely disabled persons in wheelchairs exclusively have to use the designated parking spaces. It is not permitted to transfer the disabled person from the wheelchair to a fixed seat. If a severely disabled person with a wheelchair is required to have an accompanying person, the severely disabled person must be accompanied. This accompanying person may attend the respective performance and must go to a seat provided for this purpose, which is in the immediate vicinity of the wheelchair seat. There is no entitlement to the choice of another seat with concurrent use of the discount for accompanying persons.
10.4 The private sale and resale of entry tickets on the premises and on the grounds of the Foundation is strictly prohibited.
10.5 Mobile telephones, pagers and acoustic signalling devices of all kinds may only be taken into the auditorium when switched off, or at least in flight mode and in a silent mode. It is not permitted to flash the light of the display openly during the performance.
10.6 Food and drink items may not be taken into or consumed in the auditorium, lobbies or aisles. Smoking is prohibited in the entire building.
11.1 Photography, filming and sound recording of any kind in the auditorium during the performance is prohibited. In the event of violations, the facility managerial staff is entitled to confiscate recording devices and cameras and to withhold them until the end of the event.
They will be returned to the owner if he/she has agreed to the deletion of the recordings. Non-compliance may result in claims for damages or measures according to point 11.2.
11.2 By purchasing an entry ticket, visitors to the Foundation agree that the Foundation may take photographs and film footage during the event and reproduce and publish these without any time or space restrictions. This consent is given explicitly with the waiver of any claims for remuneration.
12.1 The commercial resale of entry tickets is not permitted unless the Foundation has given its prior consent. The right of admission to a performance shall only be established by a ticket purchased directly by the Foundation or by a third party with the prior consent of the Foundation.
12.2 This regulation does not apply to the resale of tickets with no intention of making a profit. The Foundation may refuse to issue tickets to persons who engage in commercial trading in tickets without the consent of the Foundation or who make tickets available to such persons.
12.3 The Foundation is not liable for the validity of the tickets of other ticket providers or for their services or prices.
Open-air events will also take place in inclement weather. In case of inclement weather, it is recommended to bring rainproof clothing and rain capes. It is not permitted to unfold umbrellas during the event because of the associated obstruction of visibility for other visitors. Please note that the start of the event may be delayed or interrupted due to weather conditions. If the event is nevertheless cancelled before the start due to extreme weather conditions, the ticket price will be refunded at the advance booking office where the entry ticket was purchased (only on presentation of the original entry tickets within a period of 14 days).
In the event of premature cancellation of an event up to one week before the date of the event, the Stiftung Staatstheater Nürnberg reserves the right to the following services: a replacement event of the Foundation's choice or refund of the ticket price.
If an open-air event already in progress is cancelled due to extreme weather conditions, the ticket price will be refunded at the advance booking office where the entry ticket was purchased (only on presentation of the original entry ticket within a period of 14 days), but only if the performance has not yet reached half of its scheduled duration.
The scheduled playing time will be announced at the event venue. If an open-air event already in progress is cancelled after more than half of the scheduled playing time due to extreme weather conditions, the performance shall be deemed to have been performed and there shall be no entitlement to a refund of the ticket price. If individual concert and/or other parts of the show (e.g. fireworks) are cancelled, there is no entitlement to a refund of the ticket price. Fees (e.g. advance booking fee, shipping or handling fees) will not be refunded in any of the cases mentioned. There shall be no further claim for damages. Information about the course of the event will be announced at the venue. The guest is therefore requested to arrive at the event venue in any case, even if the weather conditions are adverse.
The Foundation accepts no liability whatsoever for property damage or physical injury of any kind, unless the Foundation, its legal representative or its vicarious agent have acted with intent or gross negligence. Claims for damages by the customer owing to positive breach of contract, culpa in contrahendo and tort are excluded unless the Foundation, its legal representative or its vicarious agent have acted with intent or gross negligence and no material contractual obligations have been breached. Claims for damages arising from impossibility of performance and delay as well as from breach of material contractual obligations shall be limited to compensation for foreseeable damage in the event of slight negligence. The Foundation shall not be liable for third-party services, but the respective service provider shall be liable directly.
These terms and conditions shall come into force on 07.06.2021.
In all other respects, the statutory provisions shall apply. The place of performance and jurisdiction for all claims arising between the Foundation and customers from the business relationship is Nuremberg.
Should any provision of these General Terms and Conditions be invalid, this shall not affect the legal validity of the remaining terms and conditions. The invalid provision shall be replaced by the provision that is standard for this case in the industry or, in the absence of a permissible provision that is standard for the industry, by the corresponding statutory provision.
